Terms and Conditions

This license agreement (the "Terms and Conditions) are a contract between you and Communicating Hands and describing the Terms and Conditions applicable to your use of Communicating Hands. Before using Communicating Hands you must read and accept the terms and conditions contained in this Agreement. If you do not agree with these Terms and Conditions, you will not be able to use the Communicating Hands resource and website.

1. License Grant.
Communicating Hands grants a personal, limited, non-exclusive, non-transferable license to use Communicating Hands for the web solely for the purpose of learning British Sign Language. The terms "you", "your" or "user" are synonymous, and refer to the person using Communicating Hands in any way. The terms "course" or "content" refer to the British Sign Language instructional materials delivered by Communicating Hands.

A"registered user" is a user from whom Communicating Hands has received information necessary to permit such a person to access the online learning content of Communicating Hands.

You must be a registered user:
(i) to be permitted access to the online learning content contained in Communicating Hands;
(ii) have access to Communicating Hands through your personal user name and password for a period of 90 calendar days commencing on the day payment is received for the course.

Except as expressly stated above, you are not licensed or permitted to do any of the following:
(i) attempt to access any other Signing Online systems, programs, or data that are not made available for public use;
(ii) copy reproduce, republish, upload, post, transmit, resell or distribute in any way the material from the Communicating Hands web site; or
(iii) attempt any actions that would prevent the use of Communicating Hands by any registered user or the public.

2. Reservation of Rights and Ownership.
Communicating Hands reserves all rights not expressly granted to you in this license agreement. Communicating Hands is protected by copyright, trade secret, and other intellectual property laws. Communicating Hands owns the title copyright, and other intellectual property rights in Communicating Hands. Communicating Hands is licensed, not sold. This Agreement does not grant you any rights to trademarks or service marks of Communicating Hands.

You shall not decompile, disassemble, or otherwise reverse engineer Communicating Hands except as otherwise permitted by applicable law notwithstanding this prohibition.

You must indemnify and defend Communicating Hands against any claims or lawsuits, including legal fees that arise from or result from the use of Communicating Hands on a commercial or professional basis.

Help and Support.
Communicating Hands may use a variety of methods (e.g., in-product help, internet, telephone, fax) to provide technical support and customer service in connection with the use of Communicating Hands. The terms and conditions governing the offering of this support, some of which may require the payment of an additional fee, are subject to change as announced by Communicating Hands from time to time.

3. UserID and Password Security.
You are the only person authorized to use your user ID and password for maintaining the confidentiality of your user ID and password. You shall not permit or allow other persons to have access to or use your user ID and password, except that you chose to provide that information to Communicating Hands technical support personnel in the course of providing technical assistance.

4. Disclaimer of Warranties.
EXCEPT AS EXPRESSLY PROVIDED ABOVE, COMMUNICATING HANDS INSTRUCTIONAL SOFTWARE AND ANY SERVICES ARE PROVIDED "AS IS" AND, THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMMUNICATING HANDS, ITS AFFILIATES, LICENSORS, EDUCATIONAL INSTITUTIONS, THIRD PARTY CONTENT OR SERVICE PROVIDERS, DISTRIBUTORS, DEALERS AND SUPPLIERS (COLLECTIVELY, "REPRESENTATIVES") DISCLAIM ALL WARRANTIES EXPRESS OR IMPLIED, REGARDING COMMUNICATING HANDS OR ANY SERVICES, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, TITLE, MERCHANTABILITY, AND NON-INFRINGEMENT.

COMMUNICATING HANDS DOES NOT GUARANTEE THAT COMMUNICATING HANDS ON THE WEB IS FREE FROM BUGS, VIRUSES, INTERRUPTION, ERRORS, OR OTHER PROGRAM LIMITATIONS. SOME COUNTRIES OR AREAS DO NOTALLOWTHE EXCLUSION OF IMPLIED WARRANTIES, SO THE EXCLUSIONS MAY NOT APPLY TO YOU.

5. Miscellaneous.
These Terms and Conditions are a complete statement of the agreement between you and Communicating Hands, and sets forth the entire liability of Communicating Hands and its representatives and your exclusive remedy with respect to Communicating Hands and its use.

Any waiver of the Terms and Conditions, herein, must be in a writing signed by an officer of Communicating Hands and expressly referencing the applicable provisions of this agreement.

If any provision of this agreement is invalid or unenforceable under applicable law, then it shall be, to that extent, deemed omitted and the remaining provisions will continue in full force and effect.

These Terms and Conditions will be governed by UK law as applied to agreements entered into and to be performed entirely within UK, without regard to its choice of law or conflicts of law principles, and applicable federal law.

The parties hereby consent to the exclusive jurisdiction and venue in the UK. Headings are included for convenience only, and shall not be considered in interpreting these Terms and Conditions.

These Terms and Conditions do not limit any rights that Communicating Hands may have under trade secret, copyright, patent or other laws.

These Terms and Conditions may be terminated by Communicating Hands immediately and without notice if you fail to comply with any term or condition of this Agreement. Upon such termination, you must immediately cease using Communicating Hands and any related services.

Communicating Hands shall have the right to change or add to these Terms and Conditions at any time, and to change, delete, discontinue, impose conditions on any feature or aspect of Communicating Hands (including, but not limited to course content, pricing, technical support options, or other product related policies) upon notice my any means Communicating Hands determines in its discretion to be reasonable, including posting information concerning any such change, addition, deletion, discontinuance or conditions in Communicating Hands on any Communicating Hands sponsored web site.

Any use of Communicating Hands by you after Communicating Hands publication of such changes shall constitute your acceptance of this Agreement as modified.
